User Eligibility

MKCentral and its community are only available to users who are at least 13 years old. By registering for MKCentral, you represent that you are at least 13 years of age. If you are under 13, please do not attempt to register or use the site.

Account Rules

Single Account Policy

You may only create and maintain one account on MKCentral. Creating multiple accounts ("alting") is prohibited and will result in the permanent banning of all alternate accounts. Your primary account may also be temporarily or permanently banned at the discretion of MKCentral staff.

Account Deletion and Cooling-Off Period

If you request your account to be deleted, you may not create another account for one year following that deletion. Any accounts created within one year of deletion will be removed or banned.

Account Integrity

To protect the integrity of the platform, MKCentral reserves the right to retain certain information related to deleted accounts for purposes such as fraud prevention, enforcing bans, or detecting users attempting to circumvent restrictions. This includes data reasonably necessary to uphold the security and fairness of our services.

Content Guidelines

User-Generated Content

The providers of MKCentral are not responsible for any user-generated content, events, or accounts. Content submitted expresses the views of its author only. You are entirely responsible for the content you submit and for your conduct on the site.

Prohibited Content

You agree not to submit, post, or link to any content that is:

• Defamatory, abusive, hateful, threatening, or harmful to others
• Spam or irrelevant to the purpose of the site
• Adult, explicit, or otherwise objectionable content
• Revealing personal information of others without consent
• Infringing on copyright, trademark, or other intellectual property rights
• Illegal, promotes illegal activity, or violates Nintendo's guidelines

Intellectual Property & Licensing

By posting content on MKCentral (including but not limited to profile information, tournament results, team data, and comments), you retain ownership of your content but grant MKCentral a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, and display such content in connection with the operation and promotion of the site. This license exists for as long as your content remains on the site and for a reasonable period after removal.

Community Features & Tournaments

Independent Organization

MKCentral provides tools for users to organize and participate in Mario Kart tournaments. These tournaments are run independently by community members, some of whom may also serve as MKCentral staff in an unrelated capacity. MKCentral does not organize or oversee these events and is not responsible for their content or conduct.

Moderation Actions

Moderation actions taken by MKCentral may consider user behavior occurring within these tournaments, especially where it violates our community guidelines. However, MKCentral is not liable for the actions or decisions made by tournament organizers or participants during such events.

No Endorsement

MKCentral does not endorse any specific tournament or organizer. Participation in tournaments hosted through MKCentral is at your own risk. Organizers are solely responsible for compliance with any applicable guidelines or terms set by Nintendo or other third parties.

Security

You agree not to attempt to:

• Gain unauthorized access to MKCentral systems
• Interfere with normal site operations
• Exploit vulnerabilities
• Engage in any activity that could damage or impair the functionality of the site

While our source code is publicly available, deliberate misuse, abuse, or attacks on MKCentral infrastructure will result in a ban and may be reported to appropriate authorities if necessary.

Disclaimers & Limitations of Liability

"As Is" Provision

The site is provided "as is" without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

In no event shall MKCentral, its staff, volunteers, contributors, or its affiliates be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of this site, even if advised of the possibility of such damage.

Nintendo Relationship

MKCentral is not affiliated with or sponsored by Nintendo. Use of the site, including tournament participation, is not endorsed by Nintendo. Mario Kart and all related characters, items, and properties are trademarks of Nintendo. MKCentral is not liable for tournaments that may require modified game clients or unofficial methods of play.

Enforcement & Moderation

Staff Decisions

We may remove, modify, or restrict any content or account at any time, with or without notice or explanation. Staff decisions regarding moderation are final and may be made for any reason deemed necessary to maintain the integrity and safety of the community.

Prohibited Behavior

You agree not to harass, threaten, or defame any individual or group, or to engage in hate speech or discriminatory behavior based on race, ethnicity, national origin, gender, gender identity, sexual orientation, religion, or disability. This applies to all interactions connected to MKCentral, including conduct on external platforms such as Discord or social media if it relates to your use of MKCentral.

Game Integrity

Users found to be cheating or maliciously interfering with Mario Kart gameplay as part of MKCentral tournaments or events may be banned at staff discretion.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the site. Your continued use of MKCentral after such modifications constitutes your acceptance of the updated Terms.

Termination

Either party may terminate this agreement at any time. Upon termination, your right to use the site will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Acceptance

Use of the MKCentral website and services constitutes agreement with these Terms. If you do not agree with any part of these Terms, please do not register or use the site.
